1. Introduction

These Terms of Use ("Terms") govern your use of hanmima.com and all of its pages, including online booking, the member login and the website chat (together, the "Website"). In these Terms, "Company," "we" and "us" mean Han Mi Martial Arts, 9899 Main Street, Suite 150, Damascus, MD 20872. By using the Website, you accept these Terms. If you do not agree, please do not use the Website.

2. Online booking, memberships and payments

Class booking, trials, memberships, member accounts and payments on the Website are provided through our membership software provider, Gymdesk. Payments are processed by our membership software provider and its payment processor. Any membership agreement, plan terms or school policies you accept when you book or sign up are separate from these Terms and govern your membership. Prices, schedules and offers shown on the Website may change, and the terms you accept at sign-up apply.

3. Your account

If you create a member account, keep your login details private and tell us right away if you think someone else has used your account. You are responsible for activity under your account and for any accounts you manage for your children.

4. Website chat

The Website has a chat, provided by Chatbase, that uses AI to answer common questions and passes messages to our team. Chat answers are for general information only and may not always be accurate or current. They do not change your membership terms, prices or school policies. Please confirm anything important with us directly, and do not share sensitive personal or health information in the chat. Our Privacy Policy explains how chat information is handled.

5. Intellectual property

We and our licensors own the content on this Website, including text, videos, images, logos and the Han Mi Martial Arts name. All rights are reserved. You may view the Website and share links to it for personal, non-commercial use.

6. Restrictions

You may not:

• republish, sell, sublicense or otherwise commercialize Website material without our written permission;
• use the Website in any way that damages it or disrupts other users' access to it;
• use the Website against applicable laws and regulations, or in a way that harms the Website or any person or business;
• use bots, scrapers or other tools for data mining, harvesting or extraction on the Website;
• use the Website, its forms or the chat to send advertising, spam or marketing.

7. Text messages (SMS)

Han Mi Martial Arts uses its membership software provider, Gymdesk, to send text messages to students and families who have agreed to receive them. We send only booking and class reminders, such as confirmations of classes you book and reminders before class. We do not send promotional or marketing texts. Message frequency depends on your bookings. Message and data rates may apply. Agreeing to receive texts is not a condition of any purchase.

Carriers are not liable for delayed or undelivered messages. Text messaging is intended for users 18 or older. Users under 18 must have a parent's or guardian's consent. See our Privacy Policy for how we handle mobile information.

8. Third-party services and links

The Website uses or links to third-party services, including Gymdesk, Chatbase, Cloudflare, Google (Analytics, Ads and Maps) and YouTube. We are not responsible for third-party websites or services, and their own terms and privacy policies apply.

9. No warranties

The Website is provided "as is" and "as available." We make no warranties of any kind about the Website or its content, and we do not promise it will always be available or error-free. Content on the Website, including blog posts and videos, is general information, not medical, legal or professional advice.

10. Limitation of liability

To the fullest extent permitted by law, Han Mi Martial Arts and its owners, instructors and staff will not be liable for any indirect, incidental, special or consequential damages arising out of or related to your use of the Website.

11. Indemnification

To the fullest extent permitted by law, you agree to indemnify Han Mi Martial Arts against claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms.

12. Severability

If any part of these Terms is found unenforceable, the rest of the Terms will remain in effect.

13. Changes to these Terms

We may update these Terms at any time by posting a new version on this page with a new effective date. Using the Website after a change means you accept the updated Terms.

14. Assignment and entire agreement

We may assign our rights and obligations under these Terms. You may not assign yours without our written consent. These Terms, together with our Privacy Policy, are the entire agreement between you and us about your use of the Website. Membership agreements and policies you accept at sign-up remain separate.

15. Governing law

These Terms are governed by the laws of the State of Maryland. You agree to the jurisdiction of the state and federal courts located in Maryland for any dispute about the Website.
